A BILL to amend article ten-d, chapter five of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section five, relating to the award of disability retirement.

Be it enacted by the Legislature of West Virginia:

That article ten-d, chapter five of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section five, to read as follows:
ARTICLE 10D. CONSOLIDATED PUBLIC RETIREMENT BOARD.
§ 5-10D-5. Award of disability retirement.
The board shall not award disability retirement to a member of a public retirement plan administered by the board if the reason for the disability was present at the time the member became a member of the public retirement plan from which the disability retirement is sought.



NOTE: The purpose of this bill is to determine awards for disability retirement.
